Complaints prompt changes 'At the Beach'\r Heidi Hemmat Investigative Reporter \r 9:53 PM MST, December 17, 2009\r DENVER, Colo. - It's the response ""At the Beach"" customers wanted, but never thought they would get.\r At the Beach's attorney tells FOX 31 News that the company is offering a ""courtesy cancellation"" to any customer who feels they got scammed into signing contract they could not break.\r ""We want to find out if there is a problem and if there is we want to fix it,"" said attorney Richard Ogden.\r ""Through the end of the year (January 2009), we are offering a courtesy cancellation to anyone who believes they were misrepresented in terns of their 6 months or 12 months contract.""\r The change in policy comes after our investigative report exposed consumer fraud claims made by hundreds of At the Beach customers who say they were scammed by lying salespeople who promised their ""membership could be canceled at anytime,"" but they were really signing a one or two-year contract they could not break.\r Most of the victims admit they didn't read the agreement, which clearly states it is a contract which cannot be broken unless you move 25 miles away from an ""At the Beach"" location or you can buyout the contract by paying 50-percent of the balance due on your one-year deal.\r Kevin Lanoha, who is a victim and an attorney, says he had good reason to trust what the salespeople told him, because salespeople aren't legally allowed to lie.\r ""It's called deceptive advertising,"" said Kevin. FOX 31 Investigates: Burned 'At The Beach'\r Heidi Hemmat KDVR Investigative Reporter \r 10:01 PM MST, November 25, 2009\r DENVER, Colo. - All they wanted was a tan. Instead, hundreds of Coloradans say they got tricked into signing ironclad contracts.\r Kevin Lanoha and his wife, Bridget, say lying ""At the Beach"" salespeople talked them into signing a $45 a month membership which -store employees said- could be canceled at anytime.\r ""It was absolutely clear, I could cancel at any time,"" says Kevin. But they were really signing a one year contract that they could not break.\r ""I was angry, and frustrated,"" Kevin, who is also a lawyer, told us. ""It's a pretty bold scam...I'm still actually quite shocked by it.""\r And the Lanoha's are not alone.\r Hundreds of customers from across the country have filed complaints against the tanning superstore. The Better Business Bureau in Oklahoma City, where ""At the Beach"" is based, gives the company an ""F"" rating. Colorado's BBB gives the company a ""D minus.""\r Customers claim they got duped into believing what the salespeople were saying, instead of reading the fine print on the contract.\r ""I totally feel like I was duped,"" another customer, Sean White, told us. ""No one reads the six-point font and the two page-long contract.""\r ""It's called deceptive advertising,"" Kevin Lanoha says.\r The contract Kevin and many of the others signed says it cannot be broken unless you move 25 miles from an ""At The Beach"" location. It also says any verbal agreement is not legally binding.\r Another customer we spoke with, Jordan Shore, still couldn't get out of her $2,000 contract, even after she got accepted to attend college in Australia. She even provided proof to At the Beach's corporate office.\r ""I'm not even going to be in the country, so I'm obviously not going to be using it, but I'm still paying $50 a month,"" Shore said.\r Hoyl Belt, who identified himself as a spokesperson for ""At the Beach,"" says they are aware of the complaints. He insists you can cancel if you move 25 miles away, and he says recently the company made it possible for customers to buy out their contract, by paying 50% of the balance due.\r Belt says the new ""buyout"" option is spelled out on their new contract form. And, he says, their employees are not deceiving their customers.\r ""We secret shop our stores at an expense of thousands of dollars a month to ensure information is being handled right,"" Belt told us.\r But when we went into ""At the Beach"" undercover, I was assured I could cancel my 12 month contract at anytime.\r ""You can cancel whenever you want to,"" the employee said. The salesperson never mentioned the ""buyout"" or that I'd have to move away to do it.\r A former ""At the Beach"" employee, who wanted to remain anonymous, told us she was trained to tell people they could cancel at anytime even though she soon figured out it wasn't true.\r ""I felt really bad for the customers. Many feel they are being duped for the 2nd time after finding out cancelling their contract will cost them more than the membership itself.\r \r Sarah Hurley is one of dozens of customers who say ""what they are doing is a big joke.""\r \r Hurley found out she is being charged $30 dollars for every tan she used, that's the single session rate.\r \r ""It's not a courtesy at all. If anything, it's a bigger scam.""\r \r Richard Ogden told us they are taking 100 cancelation calls a day. A ""good percentage"" of the people are satisfied with the courtesy cancellation, although he could not provide exact numbers.\r \r Ogden says if people are still unhappy, he is willing to review their case on an individual basis. These guys have a lot of beds and there isn't a wait like you find at a lot of places. Also THEY HAVE LOTS OF BEDS! I get tired of places that only have a few beds and you have to wait forever. Also, they have a lot of locations so if I'm in a different part of town I can always find one and pop in for a few minutes to tan. This place isn't the scam everyone tries to make it out to be. You do sign an agreement and they do hold you to it, but it is no different than any gym contract (Ballys, 24 hr etc) I think the confusion is that the contract goes month to month after the 12 months is up and you are canceling the month to month part. You can't just cancel the 12 months part it wouldn't be a contract then would it? I stood there and read the entire thing before I singed it. These people con you into signing a two-year contract with no way to get out of. They are rude, un-ethical and I'm shocked they are still in business with the way their customers are treated. Their front desk staff - the face of their company - know nothing about corporate polices and therefore consistently give out false information. They try to sell you a different lotion every time you walk in and the beds are crap - missing light bulbs in the majority of the rooms. Check out their Better Business Beuru ratings for a better idea about this place! They were on the news for a reason, they sell your information and contract to another company! They also do not represent the brands they say they do, I have called the companies involved. I like how they now have the same person as (""Review"", or ""Review Boost or MacBeliver"") always commenting something different. You have to sign in with your g-mail or facebook or account to review and it is all obviously the same person.Their employees are doing this! I really like At The Beach. I saw a negative tv segment on the business and as a tanner it peaked my curiosity. I had heard they have very good beds but to beware because they lie. I went to the store on Broadway. The girl showed me around the store and was extremely nice. She explained all the beds to me. I never knew the difference in beds but she was very knowledgeable and explained it all to me. I did a one time tan in their best bed. I got the best color I've gotten from a bed and I went back the next day and became a member. I did a 1 year package. Nobody lied to me like the news story said. I am very well aware what I became a member on. The pricing and the beds are the best in town and I like to tan so it worked out great for me. I don't understand why people hate this place so much. It's been busy every time I've gone to tan. They must not be all bad to have so much business and have as many stores as they have. I like this place and am glad I became a member. This place is so shady. I'm in a crappy two year contract which at first I was okay with since the lady I spoke to said I could cancel anytime with a cancelation fee and she never said it would be reported on my credit..BIG MISTAKE!!!! Yes I should of read the teeny tiney fine print, but seh was going over it and I took her word. Lesson learned! So you can not cancel unless you move 25 miles away, you have to send all kinds of stuff. The service was starting to go down hill where I was so I called and wanted to cancel so they said tough luck.. JERKS!!!!If you have been swindled file with the BBB,FTC< Attorney General, and contact news stations..This business needs to be shut down...All this headache for a stupid tanning salon!!!!! 7/30/2009 This place is nice enough...until you move out of state and need to cancel your membership. I've been trying to cancel for two weeks...have sent 4 emails, and left 14 voicemails at corporate headquarters. The local salons claim they are unable to freeze the account, much less cancel it, and only refer you back to corporate. Found a phone # for their supposed president, who claimed I'd have to call back and speak to someone else at 7am Oklahoma time. DO NOT SIGN UP FOR ANY CONTRACTS HERE!!!!!!!!!!! Pros: NONE!
