I contacted ADVANCED FOUNDATION REPAIR, 5601 W. Jefferson Blvd, Dallas, Texas 75211. ADVANCED came to my home and had me sign a contract for them to do the work. In fine print on the contract, it stated that ADVANCED would not be responsible for damage to the flower beds. I didn't want to sign the contract with that statement in it, but the foreman, or lead man, said don't worry, we will take care of any and all damages to your flower beds. I went out a couple of days later and was looking at the flower beds and noticed that some of the plants didn't look too healthy. I called ADVANCED and they said that they replanted everything properly and not to worry. I decided to withhold half of the payment for a couple of weeks, just to see what happened. I lost hundreds of dollars of plants, withheld money for these, and sent ADVANCED the rest of the money. They took me to court.. The court ruled in their favor because of the fine print in the contract. I told the judge that I was verbally told they would correct any problems they caused to my flower beds. The owner of ADVANCED asked me if I had it in writing, and of course, I said no. I was forced to pay interest on what I owed and court costs. I tried to plead with ADVANCED but to no avail. I paid ADVANCED the money left on the original contract, but did not pay the interest and court costs, and ADVANCE took out a mechanic's lien against my home. Recently, I got a contract to sell my home. ADVANCED was asked for a payoff and they doubled what I owned. I called the owner of ADVANCED and he told me that I had to pay whatever he wanted to put down for settlement. I told him that the court had already ruled on the figure and he couldn't change it. He just laughed at me. I can't say whether or not, ADVANCED was legally wrong, but they are definitely morally wrong. I guess some businesses don't care about be moral.
