James F. Messinger's so called ""mortgage officer"", convinced me to refinance my home, when she KNEW we were looking to sell our home, after she lost an opportunity to collect commission from our new home purchase when our buyers for our home backed out. She told us we could refinance to lower our payment, keep our house on the market, and if we sold it we wouldn't be out any money from refinancing. When I told her I was concerned with the large amount of money we had to come up with to refinance, she told me not to worry that the $3250 dollars we were paying upfront to HUD for mortgage insurance would be refunded to us in the event that we sold our house. She even showed me the paperwork, to show we'd get a refund. So we ended up selling our house 3 months after we refinanced, and when I called HUD they said that we weren't getting a refund, and that they changed that rule in Dec. of 2004. I was devastated as she insisted that we'd get this money back if we sold our property. I went back to the HUD paperwork she had us sign, and she provided us with OUTDATED HUD paperwork, that showed on the bottom that the last changes were in 1997. It was her JOB to know that rules were amended in 2004, and she had NO CLUE that the HUD rules were changed 6 years ago, and this is suppose to be her area of expertise!!! We sent 3 emails to Messinger & Co. outraged by this incident and asking them to make it right, and they didn't respond to any of the emails. We recently called, only to have them say someone was available to speak with then ask our name, and came back with the response, oh noone is available to assist you right now. Funny how they are quick to assist when they want to make a buck at your expense, but when they make an enormous mistake at your expense they aren't willing to admit fault and own up to their mistakes. Never in a million years would I think anyone would conduct business in this manner. We left a message stating if we didn't have a response from Mr. Messinger himself in 48 hours, we'd be filing a formal complaint and they could deal with this matter in court!! Well Mr. Messinger, and his so called ""Mortgage Officer"" and you know who you are, just a chip off the ol' BLOCK hey?? Well I guess we will be seeing you both in court!!!!! For those looking for a decent place to get a mortgage, I'd recommend looking elsewhere!!! AVOID!!! At all cost if you want someone to be honest, and have your best interest at heart and not more concerned with making money at ANY COST!!!
