Rebuttal- Point 1-Tenant was informed prior to move in that the carpets were still wet from cleaning. After great insistence by tenant, McNamara begrudgingly agreed to let tenant move into property with wet carpets, based on the fact that tenant had expressly stated that there were no concerns about the carpet. Point 2-The unit is in good condition, and is not about to collapse. All suspicions of termites are taken 100% seriously. Point 3-This tenant failed to obey Foothill Gardens Parking policy. Tenant was not only not parked in the correct spot, but also did not have their parking pass in the car at the time. They were parked in a visitor space. Due to a storm at the time, a tree had to be removed for safety. Tenants car was in the way, and with no parking pass or note telling of who the owner was or which unit was associated with it, we had no choice but to remove the vehicle. Point 4-Tenant viewed the apartment prior to moving in. If there was a concern about ""forest like bushes"" the tenant should have made a comment or elected to rent elsewhere. The complex is also located right near Cal Poly, around a very highly populated area. With so many people around, as well as an on-site manager, someone lurking in bushes would surely be noticed. Conclusion- As previously stated the apartment is in good-great condition, and is not about to collapse. We, the management do care about our tenants and hope that everyone has a safe and enjoyable living experience here. In all of our leases, we offer several different methods to ""opt-out"". If the tenant wished, they could get out of their lease very easily. This was clearly posted by a disgruntled tenant who was upset because we would not allow them to blatantly disregard the rules, in their own best interest. Bad Management + Doesn't feel safe 11/27/2007

I am currently a tenant in this complex.\r \r Well, the apartment is spacious and is close to Cal Poly campus. But unfortunately, the apartment management is BAD.\r \r 1. When I first got the apartment, the carpet was dirty. Told the manager, later he told me that it was already cleaned, but it's still the same. I need to pay for the cleaning costs too when I first move in.\r \r 2. Recently, I found some wooden dust on my carpet. It turns out that it comes from the ceiling. I think the apartment building may have termites problems. Told the manager, no response. I ended up taping up my ceiling to prevent any more wooden dust from falling. Well, if the building is going to collapse, I am going to take him to court.\r \r 3. I have a unique car. I would say the car has a striking color. My assigned parking spot is far from my apartment. But there are 3 guest parkings nearby. I use one of them, and my car was towed. Asked the manager, he said he didn't recognize the car and there is no note on the car. Well, I have been living in the complex for almost half a year, and the manager stays in the apartment complex. There is NO way he doesn't recognize the car. I need to pay more than $200 because my car was towed in my OWN apartment complex. Ironic?\r \r 4. The apartment complex is dark. Not much lighting, and there are a ""forest-like"" bushes on some part of the apartment. Believe me. It is scary. Anybody could have hidden in those bushes. Of course, you could try to avoid these dark areas, but having those around means danger. Yes, I do realize that Cal Poly is pretty safe, even at night. But better be safe than sorry.\r \r Bottom line, the good thing about the apartment is that it is spacious and it is close to Cal Poly. The apartment itself seems like it's going to break down at any minute. Plus, the management doesn't care. This actually what bothers me a lot. More over, I don't feel safe here. Too bad I already signed a year lease.\r Pros: Proximity to Cal Poly Campus Cons: Bad Management, Low quality of the apartment, Not worth the money more
