Manager Rick asked for a check for $350 from my daughter and me for a deposit on a 2BR apartment while they checked our credit and references. We also left a non-refundable check for $28 for the credit check. Multiple times before we left the apartments, my daughter and I asked about getting our deposit check back should we decide against renting there. Multiple times Rick assured us that we would, if we changed our minds. We never would have left him a check if he hadn't assured us since this was the first apartment complex we looked at, and we wanted to look at others before making a decision. When Rick's assistant, James, called me with the approval of our credit, and saying that we could move in, I apologized and said that now we wouldn't be able to make a move for a while. I said we needed our deposit check for $350 returned. He said he'd have to find out about it. Neither he nor Rick called back, and the check that was not supposed to be cashed, was cashed. My daughter and I went to the apartments on July 27 to get our check and our financial paperwork. Rick put us off saying that James wasn't in that day, and he would have to open the locked files to get our paperwork, and tell his side of the story about the deposit check. Rick said that if we didn't respond to the okay to move in within four days of leaving the deposit, it would be cashed, as stated in the documents we signed. That's the first we hear of that rule, plus we didn't get any copies of the documents to take with us. But anyway we did respond with a no on the first phone contact. Today, I called and spoke to Rick, who was to have called me today. He said he'd been in meetings all morning, and that he would get the matter resolved, that he was with someone, and hung up the phone on me. I want everyone to be aware of the potential scam going on here. I'm not giving up on getting our $350 back.\r
