I first met with Wanda Greene in Sep to discuss placing tenants in our properties. On the 26th of Nov, I emailed Wanda to ask why only 1 ad was being run in the Daily Times, when we had 2 rental contracts with Remax, & would be paying 2 fees. I asked if 1 ad could be a fsbo ad. 10 days later on Dec 6th, Wanda replied via email saying she had spoken to her broker & mgr & it was not in their best interest to run a ?fsbo? ad because if another agent brought a buyer, Remax would only get 1.5% commission (which would be $2100), & according to Wanda, this would not cover the cost of advertising. She also wrote that ?if the properties are rented, 1/2 of the first month?s rent doesn?t cover the cost of the ads already run? (this amt would have to exceed $473 for this stmnt to be true, by the way). After this, on Dec 10th, Remax began running 2 ?For Rent? ads for our 2 properties. On Jan 9th, I sent a polite email to Wanda to tell her that the 2 ads they were running were not having any luck, & asked if, instead of running 2 dull 4-line ads, maybe they could jazz up a nice 8-line ad to represent both properties? I thought it might even be cheaper. I even wrote a sample ad. 3 days later on Jan 12, Wanda wrote back to say Remax had already spent $125 in advertising with no results. ?It may be more to your advantage to advertise the ads yourself with bigger ads than the ones we are currently running for you.? Shortly thereafter, & with no notice, Remax stopped advertising altogether for our properties, 1 of which was still in a rental contract with them until March 13. If both properties rent, it would be a 750% profit for them, after fees are paid totaling nearly $1000. Their cost for advertising both places would have been only $125. They tried to cancel our contract Jan 29, even tho a 30-day written notice is required. I am also seeking retribution for the 3 wks of no-advertising - a complete breach of contract.
