All charges were dismissed Monday against a chiropractor accused of inappropriately touching a female patient, after prosecutors announced that they were “unable to proceed” to trial. Dr. Marwan Loutfi Chahayed, 53, was charged in May 2012 with one felony count each of sexual penetration by a foreign object and sexual battery by restraint for crimes that allegedly occurred about a year earlier. At a trial-readiness hearing today, two days before the case was set for trial, a prosecutor told a Pomona Superior Court judge that the District Attorney’s Office could not proceed with the case. A D.A.’s spokesman said he could provide no further detail. El Monte police Detective Ralph Batres said at the time of Chahayed’s arrest that DNA evidence was collected with the cooperation of the single alleged victim. Chahayed had been out on $125,000 bail since the day after his arrest.
