I retained him for my child custody case, and he decided (after judge's questioning of his actions) that it was in MY best interest for him to write temporary orders instead of permanent orders when the mother of my child and I agreed on terms. He would naturally for more retainer when finalization time came. In writing the temporary orders he wrote terms differently than what was agreed upon, ensuring work was needed when time to finalize came to fruition.\r \r Fast forward to time to finalize my orders, I reluctantly decided to let him finish it out, as there was retainer left. I am now sitting here 14 months later, and my case has not moved forward one step. Mr. McCarty has done absolutely nothing for me, other than to cause my family and me to be out over $5000 (for a grand total of over $8000 including his initial retainer for the temp orders).\r \r Mr. McCarty has been deceitful in his dealings with me, blaming others for his inability to move the case forward, even though I have seen proof contrary of his claims. He has been very difficult to contact. He rarely answers his phone, a good quarter of the time has a full voicemail box, and even still does not answer voicemails or emails.\r \r Finally, after over a year of being completely ineffective, Mr. McCarty was ready to set a mediation date for my case, and had told me a time and date to call him to set the mediation date. I ended up calling him a day early just to tell him that I didn't care what date he decided to pick for mediation the next day, as I was tired of waiting and would make any date work. Mr. McCarty had the nerve to tell me he could no longer do something as simple as looking at his calendar vs. potential mediation dates on the date and time he had already agreed to because he had, and I quote ""more pressing matters."" I threatened to fire him, and ended up doing so the next day after careful consideration. He then decided to fire a motion to withdraw as if he decided to withdraw on his own volition, rather than being fired for being a very very bad lawyer.\r \r I would not recommend Daniel E. McCarty Jr. to ANYONE. Let this serve as fair warning that he will not take your case and needs seriously, and will not have any sense of urgency when things are urgent.
