Breaking Ground Landscape

We hired Breaking Ground to landscape our backyard. Prior to the job, our backyard was a multi-level yard on a slight downhill, with no vegetation to speak of, mainly dirt and some shrubs along the perimeter of the house. The idea was to level the yard and design an area that our family could use which included a new deck and lawn.\r

Our backyard was completed in November and we went through the rest of the winter without any issues (there was very little rain that winter) The following winter we experienced heavy rains and one side of our backyard flooded into our garage. This happened a couple of times that winter and we decided to call Breaking Ground thinking they would take care of the damage and add some proper drainage, asking little or no payment since the flooding resulted in a lack of drainage to that particular side of the yard (They did install French drains on the other side of the yard).\r

When Heather arrived at our home, we spoke and she said she would get back to us. She did, with an estimate for $1900 to install a drain that would go out just to our back gate (around 25 ft.). We were pretty stunned.\r

Heather responded by saying it wasn't their fault but that she would do the job for half the price. By that time, we had had a lawyer look over our contract who agreed that we should not have to pay for any of the work GB would need to do. We asked Heather for mediation but she wanted us to meet first with her lawyer to see if you could reach an agreement.\r

I'm not really sure why they wanted to come over. Heather continued to deny that had any liability in the issue and their lawyer talked in circles trying to get us to acknowledge that we knew our yard flooded from the beginning (why would we not get that taken care of up front if we knew?).\r

In any case, in the end we decided that we didn't want them in our yard regardless so we ended up using another landscaper who charged us, wait for it......$430
