On May 3rd 2009 my son David Allison picked up a 26ft. AquaSport open T-Top boat with a Johnson 225 outboard motor. At the time the boat was picked up we were not aware or were we told that the Johnson motor had recently underwent major repairs and was not yet working properly. However we picked up the boat loaded our fishing gear and went off into the Atlantic Ocean for a days fishing. As we were crossing from the Gulf side to the Atlantic side the engine stopped for no apparent reason but was restarted without difficulty. While we were in the Atlantic we had another instance where the engine stopped and again easily and quickly restarted. We had used the boat approximately five and one half (5.5) hours on May 3rd. On May 4, 2009 we again tried to use the boat, we had a hard time getting the boat started at the dock but after several try’s the boat did start and we left the dock around 11:00 am traveling North West in the Gulf approximately seven (7) miles from our dock to a fishing spot we had marked on our GPS last year. Not doing well at that spot we tried to get the boat started and after two or three attempts the boat started we then pulled up anchor and continued in a North Westerly direction about one and one half (1.5) additional miles. After fishing in that spot for an hour or so, we decided to go the Capt. Hooks, fuel up and try fishing in the Atlantic. While running from our second fishing spot toward Capt. Hooks the motor stopped, we were able to get it started again and continued for about another half mile when the motor again stopped and we were unable to get it started. That’s when we call Fish N Fun for advice and assistance; it was now about 3:00 pm and we were about eight and one half miles off shore (N24.49.0898 & W81.0.0728) we were told that someone would come to assist us and someone (who later claimed to be a 50% owner of Fish N Fun Boat & Watersports Rentals) did arrive at 4:15 and took us in tow a short distance then came aboard and tried to start the boat, being unable to get the boat started he returned to his boat and towed us from (N24.49.2282 & W81.0.2276) to Fish N Fun Boat & Watersports Rentals dock (N24.43.0324 &W81.5.0403) a distance of approximately eight and one half (8.5) miles at a speed of six and one half (6.5) M.P.H. a tow lasting over two (2) hours. (My wife Connie had made arrangements for the boat rental approximately two (2) weeks prior to my Son David picking up the boat and charged the rental to our Visa Debit card.) When we arrived at Fish N Fun’s dock I told the person who had towed us in (hereafter called Sam) that I didn’t want to use that boat any more and that I wanted him to refund the money that had been charged to my credit card. I told him that this was the second time that I had rented a boat from Fish N Fun and that the first rented boat was also defective (inoperative bilge pump) and the boat nearly sank with us in the Atlantic last year, I didn’t want any more boats from Fish N Fun. I did agree to pay for one day’s boat rental of $285.00 but that was not acceptable to Sam. Sam kept insisting that I take another much smaller boat for the remaining four (4) days of our agreement. The boat Sam was offering was too small and unsafe for off shore fishing in the Atlantic Ocean and I refused to accept that smaller boat and Sam had no other twenty six (26) ft. boats available. I again asked Sam to refund the unused portion of the money that had been charged to our credit card and again offered to pay $285.00 (the published one days rental for the twenty six (26) ft. boat that we had) but Sam again refused stating that we had rented that boat for the week and we were going to pay the weeks rental fee charged to our credit card (the fee charged was $1,419.00) which was not the agreed upon price when the boat was ordered. (The agreed upon price was $1,260.00 for six days rental). Pros: Poor Cons: Poorly maintained equipment
