I was appalled to learn that our former realtor, Remax Properties West (?The Kiper Team?), covertly recorded our home telephone conversations and threatened to use them for purposes of ?getting our commission.? While such nonconsensual recordings may be lawful in Missouri, they do not speak well of realtors who think that engaging in such practices to strong-arm clients will alter their obligations under a contract. We have audio evidence from the realtor admitting to such practices, and wanted to bring notice of it to the public?s attention so our fellow home-sellers and home-buyers in Missouri are aware of what is happening out there. Just because someone can do something doesn?t mean that they should, and the informed seller or buyer ought to be aware of who they are dealing with.
For out of state buyers/sellers, such practices may be illegal on both state and federal grounds. We encourage affected parties to seek legal counsel if they believe they have had their rights violated, and bring the matter to the attention of local and state law enforcement authorities, as we did.
