Novakoski Floor Covering Service (NFCS) charged an $878.58 hidden restock fee to this senior citizen, veteran, and single parent of 3 adopted young children. Even-though the order was canceled within 24hrs., Small Claims Court ruled (on 02-14-11) that Indiana Law does not protect customers from hidden fees on flooring: and, businesses like NFCS are not legally required to reveal restock fees to customers. I had canceled my order the next morning. The owner said he did not know the cancellation procedure because the order had been placed on the last day of the sale. He did not contact me over the next 2 days; so, on the 3rd day, I went back into the store. It was at this time, for the first time, the owner mentioned the restock fee. I had not signed an agreement; but, I had left a deposit check on the day of my order. I later discovered that NFCS had deposited the check immediately after I had asked them to cancel. I didn't stop payment on the check because I didn't realize I was being scammed. NFCS withheld $878.58 of my deposit.
