Kitchen Tune Up (KTU) was hired to reface cabinetry in our kitchen. The veneer used for the cabinet face frames kept coming loose and the application of it was quite sloppy (debris ""lumps"" behind it, edges not cleanly or accurately cut, etc.). After the veneer came loose twice in several places, we told KTU we did not want a third application and that they could paint the face frames instead. KTU refused to paint the face frames and informed us that, because we would not let them apply veneer a third time, we had breached our contract and therefore they had no obligation to finish other parts of the job that still weren't done. KTU then stopped work on the job and filed a lien on our property for the balance on the contract even though much of the contracted work was not done. We did not pay off the lien but instead took KTU to small claims court and won. KTU appealed and we won again. The appeal court awarded us $2,891.00 for veneer that was removed and for work we had to hire other contractors to do, $120.00 in court costs, and $450.00 in attorney's fees because we had to consult with an attorney to initiate getting the fraudulent lien removed. (By law, a contractor may file a lien ONLY for the value of work actually completed. At the time KTU stopped work they owed US money because we had already paid 90% of the contract total.) Throughout the period of the job KTU was difficult to communicate with, and the two personnel (the owner and her son) present at the court hearings both told the judge many untruths. Fortunately, it was easy to prove their dishonesty.
