On August 20, 2007 I entered into a ?Membership Agreement? with Workout Anytime. The conditions of the agreement provided that ?ladies join free?. I paid a $20.00 enrollment fee and two monthly payments of $34.00. My total payment was $88.00.\r
\r
Per the agreement, consumers (I) have a right of cancellation via letter ?postmarked by Midnight on August 27, 2007?. I postmarked a certified letter to Workout Anytime prior to midnight on August 27, 2007 to cancel my membership.\r
\r
The agreement states and I quote upon cancellation of the agreement ?seller shall be entitled to retain a fee of $25.00 in addition to an amount equal to the value of services made available for use?. \r
\r
I used the membership/gym for less than one (1) week. However, I paid a membership enrollment fee and two full months. In my opinion I am due no less than a $51.00 refund.\r
\r
I made several attempts to discuss this matter with customer service and the company corporate office. None of my e-mails (total of 3), faxes (one was dated September 4, 2007), telephone calls (two where I left messages) nor my initial certified letter were responded to in any way. \r
\r
A company should not be able to retain money for services they did not provide. Per their contract I am entitled to a partial refund. This company has ignored all communication and resolution efforts. \r
Pros: The deal sounds good.
Cons: They don't respect their customers enough to return calls or communicate company policy.
