I have been asked by Reverend Diann Davisson of Sail Properties (under threat of legal action) to clarify my previous comments and to accurately discuss my experience with Sail Properties. On that note, I would like to clarify that the problems I experienced with the complex (i.e. barking dogs, neighbors smoking odors entering my unit, upstairs noise, plumbing leaks) were not the fault of Sail Properties. Additionally, Sail Properties offered to let me out of my lease without penalizing me.
Reverend Davisson also asked me to clarify that my full deposit was returned to me. While I did receive my full deposit, it was not for more than a year after I vacated the premises. After trying unsuccessfully to get Sail Properties to return my deposit, I was forced to seek recourse through the legal system by suing Sail Properties in Small Claims Court. After I had the Sheriff serve Sail Properties with the Order to go to Court, I received a phone call from Reverend Davisson stating that they [Sail Properties] had just received my ?love letter? from the Sheriff. Reverend Davisson stated that Sail Properties did not have my deposit, and that the property owner is the person that needs to be sued in order to recoup my deposit. I did not have any information for the property owner, and Reverend Davisson would not provide it. Reverend Davisson also threatened to counter-sue me if I continued to proceed with my legal action against Sail Properties.
Rather than drop my case under threat of counter suit by Reverend Davisson, I went back to court and filed an Amended Order to go to Court, which, as indirectly suggested by Reverend Davisson, included naming the property owner (an elderly woman), as well as Sail Properties (the owner?s agent). Approximately one week prior to the hearing date, I received a phone call from Reverend Davisson, who stated that they would be willing to return my full deposit if I would dismiss my case against Sail Properties and the property owner. Reverend Davisson informed me that the property owner was an elderly woman, and that the owner was upset at the way Sail Properties had handled the case. I agreed to dismiss the case, and Sail Properties finally returned my full deposit (and I will add that Sail Properties was also nice enough to honor my request that they also pay my $50 court costs).
I am of the opinion I that I should not have had to go through all the efforts that I did to obtain my deposit. It is also my opinion that Sail Properties acted unfairly and dishonestly in their efforts to retain over $1,000 of my deposit. I am also still of the opinion that I would NEVER rent a property through Sail Properties again, and I would NEVER recommend them as a management company to any property owners.
