Not happy with Lambert Concrete! On 10/23/13 at 4:17pm I was driving North bound on 75- just about to exit the Ooltewah exit when a huge rock came flying thru my windshield from Lambert Concrete truck #60. I followed the truck to the Lambert Concrete office and approached the driver David Patrick, as I did the manager Jason Frey came out of the office. I explained to both of them as I was exiting the Ooltewah exit I watched a huge rock come from their truck and break my windshield. The manager Jason said ""there is no way it came from their truck because that truck was on an asphalt job."" I was pretty sure it was a concrete truck but I didn't argue with him about it. He said they would not take care of the windshield and to call the Collegedale police department. He also said ""we aren't liable because we have a sticker on our truck that says to stay 150ft back."" This truck did not have that sticker and I have proof of it because I took pictures of the truck. I called the police department, but because this incident happened on 75 N in Hamilton Co I had to drive over to the BP gas station in Ooltewah and meet a Hamilton Co Police officer to file the complaint. I filed the complaint #13-103885 with officer Sharp. \r
The next day I went to ABRA Autobody and got a quote for $524.89 for a new windshield. I took that quote to the manager Jason Frey and explained to him I wasn't trying to be difficult but I wanted it fixed. He said he would call me later in the day after he talked to his boss. At 3:30 I received a call from Jennifer a representative from Lambert Concrete she left a message and I tried to call her back but was unsuccessful until Friday morning. When I got a hold of Jennifer she told me that Lambert Concrete was not responsible and that it was an ""act of nature"" and I needed to ""file an insurance claim"" she confirmed that it was a concrete truck and I explained to her that Jason the manager then lied to me and told me it was an asphalt truck. She said that I would have to file a claim with my insurance company. I explained to her that my comprehensive coverage deductible was $500 and that wouldn't make any sense for me to file a claim because I would still be out $500 and then I would have a claim against me. She didn't care and said that was my option. \r
How can you say this is an ""act of nature"". I doubt a police officer would let that fly- if someone putting something in the back of their truck bed (knowing it is going to fly out) and when that something flies out of the truck bed and they get pulled over for littering they tell the cop it was ""an act of nature""- quite sure they would end up with a ticket. \r
I am very upset that this company isn't taking responsibility for their equipment and what happened.
