When I decided to work with Check it Out, it was due to not having money to cover my rent. I had a steady job, good cash flow but was off of work for a week due to sickness and needed some extra cash to get by. I then ran into many money issues as my wife lost her job and we was not able to pay the full amount back at once so we would stop in and make payments when we could. We have been doing this now for a while and there was not many issues. Then, the pas few calls that we have gotten from them, they have been lying and stating that they will send us to jail if we do not pay. When they called back I informed them that per ""Iowa's Fair Debt Collection Practices Act, Iowa code 537.7103"" and ""Consumer Fraud Act, Iowa Code 714.16"" It is a violation to make false representation about legal status of a debt. Now if they stated they were going to take me to small claims or send it to a collection agency, then yes, they have every legal right to do so, but to try and SCARE people with jail is plane wrong! \r

I live about 25 miles away from their office and this all started because I let them know that I would be in their area in 3 days and could drop off another payment on the account and they stated that if the money was not in by the end of the day today, then it would not do me any good. They then called back and spoke with my wife and informed her that the payment I made just 2 weeks ago was not showing up in their system and thus we had not made a payment in over a month. She argued with them for a few minutes and hung up the phone because they were lying to her about the payments we have made. \r

Then they called back with more threats of sending us to jail and stated the only way they would hold the account for 3 days is if we were going to be paying the full amount due. I informed her that I did not have the money to pay the full amount due and told her if they wanted to continue to break the law by threatening jail, I would take them to court myself per the above mentioned Iowa codes and have them shut down. She then quickly stated that she has already spoke with the county attorney and hung up on me. \r

That has been my experience with them. I do not like using payday loans anyway because the fees are VERY high but I also understand that there are times were you just have to do it anyway to pay bills.
