B-n-H Towing holds an auction open to the public; the auction is on the last Monday of every month at 1:00 pm. The auction procedures are as follows:
* Pursuant to RCW 46.55.130 the following procedures must be followed in the auctioning of abandoned vehicles by a Registered Tow Truck Operator.
* A copy of auction procedures shall be posted at the bidding site.
* Notification of auction must be published not more then 10 days and not less then 3 days in advance of the auction.
* A three-hour public viewing period shall be held before the auction.
* If the bidding site is different from the licensed office location the operator shall post a clearly visible sign at the office location that describes in detail where the auction will be held.
* A copy of the newspaper advertising listing the vehicles for sale shall be posted at the bidding site
* The open bid process, including all written bids, shall be used so that everyone knows the dollar amount that must be exceeded.
* If an operator chooses to use the pre-auction bid method, written bids identifying the specific vehicle and the amount bid may be submitted up to (5) five days before the auction.
* Auctions shall be held during daylight hours of a normal business day.
* The auction shall be held in such manners that all persons present are given an equal time and opportunity to bid.
* All bidders must be present at auction unless they have submitted written bids (the operator may choose not to use the pre-auction written bid method).
* The highest two bids received shall be recorded in written form.
* In case the high bidder defaults, the next bidder has the right to purchase the vehicle for the amount of his or her bid.
* If the operator elects to bid at the auction, that bid must be disclosed as such, and May not merely be an effort to set a minimum for other bids.
* The successful bidder must apply for title within fifteen days unless provided otherwise by law.
