Peak's doesn't honor contract addendum 4/27/2011

In October 2010, I joined Peaks Fitness WITH the addendum that if an existing condition was worsened by exercise, the contract would be terminated. They assured me this was acceptable, although I never did receive a copy initialed by both parties, as promised. I went on an extended business trip 40 days later, although the monthly fees charged were not put on vacation. When I returned, I did suggest that I thought the club should provide an introductory instruction class on how to use the equipment. They did so at this time. I followed the instructions learned at this hour class. About 5 weeks after returning to the club, I was in severe pain in my shoulder, the previous condition. I tried to call, but there number only led to their FAX. I tried many times to FAX, but the FAX was (and had been and still is) broken for some time. I caught the mailman on March 30th and sent a letter delivered on April 1st. I asked that they call when their phone was again working, as well as notified them of the upcoming surgery and termination of the membership. My Rotator Cuff was some 90% destroyed. The surgery took 2 hours and recovery will be months if not longer. Peaks ran an additional charge on April first. I assumed this was a case of the mail on the desk being read after charges were made, and expected the credit to be issued. I called around the 20th. April to ask about the missing credit and was told the message would be delivered. I again asked for a return phone call. After no response, I again called on April 27th. Demanding a return call, but at end of day, no response. After 4 weeks of non-responses and ignoring letter and calls- lesson learned; Peaks Fitness is very helpful at pre signing, but do NOT expect them to honor the contract in the interest of the client. more
